OWNERS of a town centre takeaway showed ‘bare-faced cheek’ by continuing to serve food outside licensed hours despite numerous warnings from the council.

Court action could now be taken against Pizzeria Italia, on Allhallows Lane, Kendal, if they continue to breach planning conditions.

In 2008 the owners of the takeaway were told they could not serve food past midnight on Fridays and Saturdays, or after 11.30pm on Sundays to Thursdays.

But a report before South Lakeland District Council’s Planning Committee heard the takeaway had been in breach of that several times since November last year.

Police have also contacted SLDC saying they have ‘ongoing investigations relating to late night drinkers’ at the premises, the meeting heard.

Coun David Williams said: “This is a case of bare-faced cheek. They were advised by letter and took no notice.”

The takeaway will now be served with a a breach of condition notice. The next step would be court prosecution.

The report’s author noted: “This is a prominent area to visitors of Kendal and a busy pedestrian route for residents of Beast Banks and Greenside. The site is attracting late night drinkers who congregate in this corner of town.”

It said that a letter had been sent to Pizzeria Italia in November 2013. The manager was informed and reminded of the restricted opening hours.

Officers then witnessed a number of breaches in January and February.

A second letter was sent, warning that a breach of condition notice could be issued.

But throughout March the takeaway was seen to still be selling food past midnight on four separate occasions – including on Sunday March 16 at 2.40am, said council papers.
