A DRUNKEN South Lakeland man spared jail for a vicious night-time attack has now been locked up after he committed a similar crime.

Shaun Michael David Gardner, 26, was given a suspended 18-month prison term in October, 2015. That followed his attack on a man close to Carlisle railway station in the early hours of a Sunday morning last March.

Gardner delivered three savage unprovoked kicks to the face of Christopher Adams, and was so drunk he did not remember an assault. Mr Adams later underwent a CT scan and X-rays in hospital.

But while subject to the suspended sentence, Gardner got himself in further trouble while on a night out in Kendal on 21st May.

Carlisle Crown Court heard today how he kicked the upper body of a man who was sitting down while being detained by police.

Gardner, of Kettle Houses, Burneside, who admitted assault by beating, was said to be "remorseful and ashamed" for his latest drunken episode.

But he was given an immediate 10-month prison sentence by Judge Barbara Forrester.
