HSE encourages Cumbrian householders to clear snowfall

Householders in Cumbria are being urged not to let unfounded worries about “health and safety” prevent them from clearing snowfall at their properties.

The Health and Safety Executive (HSE) has issued a reminder after a blast of bitter winter weather threatened to cause disruption in the county.

Official advice from the Government makes clear that people are unlikely to be sued or held legally responsible for any injuries if they have cleared the path carefully.

David Sowerby, HSE’s Regional Director for the North West, said: “Too often we see health and safety reached for as an excuse for not doing something.

“We want to be really clear that there are no health and safety reasons to prevent people from clearing snow and ice from their own or a neighbour’s property.

“Don’t be put off clearing paths because you’re afraid someone will get injured. People walking on snow and ice have a responsibility to be careful. As long as you use a bit of common sense, the law is on your side.”

Employment Minister Chris Grayling said: “There are lots of health and safety myths in our society and we are working hard to slay them. We want people to do the right thing and we won't let the law get in the way.”

Its very easy for the HSE to sit there and say everything will be ok but ultimately if someone slips on your path and decides to sue you its a civil matter and the HSE won't get involved... also what does "cleared the path carefully" mean what I think is carefully may be a totally different interpretation to theirs..

What is their stance when people clear the footpath outside their house, this is council land and surely if you are not a council employee will not be covered under their insurance if someone has an accident, in this instance would the council sue you??

The law is undoubtably an ****- look at the decision which is likely to result in the unqualified release of 'a danger to society' in the news today. Therefore the point above about it not being the HSE that will sue you, but ShysterCorp. Lawyers Inc. is a good one. All this 'unlikely' stuff won't help then.
