MAPS STATEMENT MODIFICATION ORDER 2021 -SECTION 119 HIGHWAYS ACT1980 SECTION 53AI2) WILDLIFE & COUNTRYSIDE
ACT 1981 DIVERSION OF FOOTPATH 264009/201004, KING'S WOOD, WYTHOP AND ABOVE DERWENT PARISHES
On 12 October 2021 we confirmed the above order to divert the footpath in King's Wood between NY 2081 2811 and NY 2153 2793 to a new line varying from five and fifty metres to the south, as shown on the order plan. A copy of the order and plan may be seen during office hours at Allerdale Borough Council, Allerdale House, New Bridge Road, Workington, CAM 3YJ, at the Lake District National Park Authority, Murley Moss, Oxenholme Road, Kendal, LA9 7RL or at Keswick Tourist Information Centre, Moot Hall, Keswick, CA12 5JR. Any person who wishes to claim compensation under Section 28 of the 1980 Act for depreciation or damage by disturbance arising as a result of the order must make a claim in writing to the Solicitor to the Authority to arrive not later than 29 April 2022
The order will come into force on 29 October 2021. If any person aggrieved by the order wants to question its (their) validity, or any provision contained in it, they can apply to the High Court within six weeks from 29 October 2021. The grounds for applying are that: the order was (were) not made within the powers of the Highways Act 1980 (as amended), or that any requirement of the Act (as amended), or of any regulation made under the Act has not been complied with.
