NOTICE OF FIVE RIGHTS OF WAY CHANGES
1-4: DEFINITIVE MAP MODIFICATION ORDERS WILDLIFE & COUNTRYSIDE ACT 1981 - SECTION 53 THREE ORDERS MADE ON 17 SEPTEMBER 2018 WHITWELL & SELSIDE PARISH
These three orders, if confirmed as made, will modify the Definitive Map and Statement for the area as described. Copies of the orders and plans may be seen during office hours at South Lakeland District Council, South Lakeland House, Lowther Street, Kendal, Cumbria, LA9 4DQ, at the Lake District National Park Authority, Murley Moss, Oxenholme Road, Kendal, LA9 7RL and at Kendal Post Office, 75 Stricklandgate, Kendal, Cumbria, LA9 4AA. You can also buy copies from the Authority for £3 each.
Any representations about, or objections to, the orders should be sent in writing to the Head of Park Management at the above (LDNPA) address; to arrive no later than 9 November 2018. The grounds for the objection or representation must be included.
1. RIGHT OF WAY 585025, KATEBARROW LANE
This order will amend the status of Katebarrow Lane, Garnett Bridge (SD 525 994 to SD 520 998) from a bridleway to a restricted by way as shown on the order plan.
2. BRIDLEWAY 585028, ABOVE PARK ROAD
This order will add a bridleway from the A6 opposite the junction with the U5280 east of West View (SD 532 998) west-nortlvwestwards to the U5276 (Old Shap Road) south west of Plough Farm at SD 530 999 as shown on the order plan.
3. BRIDLEWAY 585027, PART OF LADY COAT TARN ROAD
This order will add a bridleway from the existing BW 585026 north of Mosergh Farm (at NY 524 005) north-north-westwards along lonning to foot of Whiteside Pike (NY 522 008) as shown on the order plan.

4. MODIFICATION OF RIGHTS OF WAY 585023, 523003, 532005, 361005, 355001, & 361004, "OLD SHAP ROAD" PARISHES OF WHITWELL & SELSIDE, FAWCETT FOREST, SHAP RURAL AND ORTON
We have confirmed the above order which has modified the definitive map to show the following sections of the Old Shap Road as Restricted Byways rather than Public Bridleways, as shown on the order plans:

? Thorn Cottage to Wolfhowe; NY 5422 0132 to NY 5469 0238
? Hause Foot to Shap Summit; NY 5501 0555 to NY 5529 0680
? Packhorse Hill; NY 5532 0683 to NY 5655 0866

The order came into force on 17 September 2018. If any person aggrieved by the order wants to question its validity, they can do so by applying to the High Court within six weeks from 27 September 2018. The grounds for applying are that: the order was not made within the powers of sections 53 or 54 of the Wildlife & Countryside Act, or that any requirement of the Act, or of any regulation made under the Act has not been complied with.
5. PUBLIC PATH DIVERSION AND DEFINITIVE MAP & STATEMENT MODIFICATION ORDER 2018
SECTION 119 HIGHWAYS ACT 1980
SECTION 53A(2) WILDLIFE & COUNTRYSIDE ACT 1981
DIVERSION OF FOOTPATH 583005, ORCHARD HOUSE, WITHERSLACK PARISH
We have confirmed the above order diverting two sections of the footpath at Orchard house to a line a few metres further west (SD 4312 8400 to SD 4311 8406) and a few metres further north (SD 4313 8407 to SD 4316 8409), as shown on the order plan.

Any person who wishes to claim compensation under Section 28 of the 1980 Act for depreciation or damage by disturbance arising as a result of the order must make a claim in writing to the Solicitor to the Authority to arrive not later than 30 March 2019
The order comes into force on 27 September 2018.
