A WOMAN'S request to have her abuser's restraining order waived was rejected by magistrates on Thursday.

Jenna Dougan, 33, pleaded with the court to either vary or discharge a restraining order which stops Daniel Miller from contacting her and entering her home address in Barrow.

Ms Dougan told the court that she approached Miller because she still loves him despite the order and has been receiving support.

She told the court: "We met on Abbey Road and he got arrested for it, but it was all my fault because I went up to him.

"We're both 33 and we just want to settle down now and be together.

"I have been going to Unity on Duke Street for counselling support and it has been helping me."

However, the court heard that Cumbria Police and probation service both have their concerns about Miller, of Annan Street, Barrow, interacting with Dougan.

The chair of the bench Mr Halshaw said: "We are refusing your application today.

"We have heard your case to vary or remove the existing order.

"12 months ago there was an extremely offensive act on you and it was felt at the time, the appropriate measure was a restraining order.

"You are satisfied that there has been a limited improvement from yourself.

"We have seen that Mr Miller still provides a risk from the probation officer."

Miller, of Annan Street, Barrow, was given the two-year restraining order on 11 June 2020 following a domestic incident involving Ms Dougan.

On 28 May 2020, Miller committed actual body harm as he attacked his partner Ms Dougan at his home.

Ms Dougan was sleeping on a sofa, before Miller entered the room and bit her ear.

The court heard that Miller then continued to attack Ms Dougan as he suspected she had been sleeping with his brother.

Miller was jailed for 16 weeks following the offence and ordered to pay £200 in compensation to the victim.

In February 2020, Miller was jailed for six weeks after assaulting the same woman.
